Unit Titles (Strengthening Body Corporate Governance and Other Matters) Amendment Act 2022 

Contains all amendments to the Unit Titles Act 2010, passed into law on 3 May 2022

Progressive Implementation in Three Stages 

The Unit Titles (Strengthening Body Corporate Governance and Other Matters) Amendment Act 2022 (the Amendment Act) became law on 9 May 2022.  

The Amendment Act will come into force in three distinct stages starting on 9 December 2022.  

The BCCG Executive has set out, in a 2-Part implementation paper, the details of the three distinct stages that the Act will come into force and which sections are included in each stage. The paper provides Members some brief commentary about what is coming into force in each stage. 

Key implementation dates are 9 December 2022, 9 May 2023 and 9 May 2024.

Unit Titles Act 2010

Contains all relevant legislation governing bodies corporate.

Unit Titles Regulations 2011

Contains all relevant regulations governing bodies corporate.

Residential Tenancies Act 1986

Deals with tenancies in residential situations, including in a body corporate environment.

Health and Safety at Work Act 2015

Legislation related to responsibilities of BC chairs and committee to keep workers safe within their building and common areas.

Building (Earthquake-prone Buildings) Amendment Act 2016

Related to earthquake prone buildings - time frames for strengthening etc. Much of this is for Territorial Authorities (councils), however, it does include sections for building owners too.

Building Act 2004

Legislation related to building standards and earthquake prone buildings (but see the Amendment Act 2006 for the latest on EQ prone buildings, as these have not yet been incorporated).
