BCCG calls for review of the Unit Titles Act 2010
Submission on Possible Amendments to the Unit Titles Act 2010 ("The Act")
At the SCANZ Conference in November 2025, Tim Jones raised concerns with the Minister for Building and Construction about whether The Act remains fit for purpose to govern apartment buildings as urban intensification increases. The Minister acknowledged the importance of the issue and invited BCCG to identify areas where legislative improvement should be considered.
BCCG subsequently provided the Minister with a detailed submission, identifying 13 areas for potential reform. These included licensing Body Corporate managers, improving insurance and repairs & maintenance provisions, mandatory emergency management planning and long-term maintenance funds, addressing proxy farming and dispute resolution, committee member education, improving the disclosure regime, stronger enforcement of operational rules and the Code of Conduct, model rules, and clarification around body corporate bank accounts.
Minister's Response
We have since received a response from the Associate Minister of Housing. The Minister acknowledged BCCG’s constructive feedback and noted that several of the issues raised - including emergency management, body corporate rules, and committee education - warrant further discussion about potential regulatory and non-regulatory improvements.
BCCG’s submission has now been referred to officials at the Ministry for Cities, Environment, Regions and Transport. They have indicated they are interested in discussing the proposals and are arranging a joint meeting with SCA (NZ) soon. These discussions are expected to help inform future policy work on the Unit Titles Act.
