Clarification of Asbestos Regulations
New Asbestos Regulations came into full effect on 4th April 2018.
Health and Safety at Work (Asbestos) Regulations 2016 (LI 2016/15)
BCCG provided members with a preliminary view on what this meant for Unit Title BC on 21st March.
Following discussions by BCCG with WorkSafe personnel a number of clarifications were made by WorkSafe in three important areas and a clarification provided on 13th June by BCCG to its members:
- Basis of reasonable grounds to believe that asbestos or ACM is not present - refers to s10(3)
- Unless there are clear and obvious signs of a potential asbestos hazard, a survey is only required if work is being planned or carried out - refers to s13

The primary responsibility for compliance with the management of the Asbestos Regulations during the course of maintenance or refurbishment rest with the party contracted to carry out the work
