Section 88 UTA – Remote BC Meetings Extension (No 2)

The BCCG notified all members, in May of this year that, due to COVID-19 Alert Level restrictions, the UTA was to be amended to allow BC committee meetings and general meetings to be held by audio link, by audio-visual link as well as in person.  The Act was previously silent on the validity of BC decisions made via remote meeting media.  In the event, the Amendment was passed but it had had an expiry date - linked to the Epidemic Preparedness (COVID-19)Notice 2020. 

We have just learned that on 24th September 2020, the Epidemic Preparedness (COVID-19) Notice 2020 was extended to through to 23rdDecember 2020.  The effect of this extension is that there is a corresponding extension of the period that the Amendment will remain in place. 

In simple terms these changes mean that the temporary ability to run remote meetings under Section 88 of the Unit Titles Act 2010has been extended and will now end on 16th March 2021.

This is the second extension and it is possible it will be extended again.  We note that the Prime Minister also has power to revoke the Epidemic Preparedness Notice early, so we will all need to maintain a watching brief.  The BCCG will continue to monitor these changes and will update members as soon as we have reliable information to share.
